- August1, 2009--The Supreme Court in a judgement that shows a weakness to deal with the most important issue that teh courts have avoided dealing with over teh last five decades ie teh illegality of martial law/coups in all their forms and personalities...Avoiding attacking major personalities present and past it declared teh Nov3 actions of musharaf as COAS were illegal and thus declared all such actions as having no effect...Importantly it referred all the SC judges who had taken oath under teh PCO to the SJC to deal with...it referred teh NRO to parliament to deal with in 120 days...it literally fired all judges appointed by musharaf and sent back all high court judges from teh SC and promoted judges back to teh lower levels of judiciary...the order effects 110 judges...Dogars actions barring minor actions and zardaris oath were declared of no effect...The judges have again dealt with matters that they saw as personally important as judges and avoided dealing with the illegality of army rule and rulers...while the judgement shows the judges weakness viz dealing with musharaf it will open teh way to declare past pro musharaf and pro army rule judgements as invalid and not according to the law...It also dismantled the islamabad high court as unconstitutionally formed however its CJ was not fired as a judge...the judges have walked thru a minefield without too much damage to themselves or musharaf who had said that he alone is not responsible and they should blame all teh corp commanders too...teh judges will eventually have to deal with the illegality of military rule and give a meaningful punishment to musharaf and teh major players who went along with him...many are suggesting that musharaf be given exemplary punishment and all his assets and property be seized and disposed off for charity...others are suggesting teh death sentence for breaking teh constitution and plotting a coup and subordinating himself and teh country to india and teh USA for personal financial gain...

How it all started...coups and politics and islam and democracy...

total humiliation...India had steadily destabilized east pakistan over twenty years playing on ethnic, financial, development and military concerns...pakistan was not that rich at that time and the ethnicists played on phsychosis generated by cyclones, floods, tea and jute...the army and west pakistani politicians could not accept a bengali dominated government and a small army contingent could not defend against the mukti bahini and the indians as teh US withdrew its support as usual...When teh going gets tough teh US chickens out as usual...!! The indians have continued teh same themes in karachi, sindh and balochistan but similar tougher responses have not allowed their success although pakistan is now at best a divided land with a pathetic center...!!While it left pakistan numb at the time many now feel the seperation was a proper solution as east pakistanis did not get along with pakistan and they would be better able to solve their problems with india...others still pine away for the lost land of rivers, tea and jute...others suggest that india should handover kashmir in exchange...while some still want to repatriate those considered pakistanis and left stranded in bangladeshi camps...others however heave a sigh of relief as teh problems with the remaining provinces are generally insoluble.....and ethnic regionalism or provincialism mixed with economic and racial nonsense is not a pleasant mode of politics anyway...
