Feb29-2024--The hearing of a reference of the death sentence of Zulfikar ali Bhutto seems more personal than in any real context of the law...in historical cases reopening is only allowed when there is new evidence...it was a different era and probably only a nascent democracy at best...Zulfikar ali bhutto had taken power from a martial power on the crumbling of its defences in east Pakistan from where the army had run away in abject surrender...he had probably setup the FSF in the context of the center having no protection from what is now called the establishment...technically he had setup the martial law from a election which he supposedly had rigged or his people did...!the amicus curiae like aitezaz ahsan are really not very honest or reliable...taking up a case where a death sentence supposedly hurt some peoples personal dignity is not a courts job...the judges involved like samdani, maulvi mushtaq and nasim hasan shah were probably not great jurists and judges were bearocratically appointed in those days, CJ anwar ul Haq had been DC in sialkot...The court should first decide whether there is a case of reopening or trashing the case and then study the evidence...Bhutto's lawyer had mounted a political defence as has been done by the present CJ...if the case is reopened than should it be tried in a sessions court ...probably no and will again be sent up to the LHC for hearing...todays judges are a bit different and some have judicial activism while others thing they are morally superior to police and politicians and rulers...but no real brilliance or difference has been noticed...so the case is based solely on the person being a victim or against the establishment and whether he ordered the FSF to carry out such a task...one can assign any reasoning or alignment for a previous evidence...was the FSF chief a bhutto opponent....did he manufacture evidence...it was one person against bhutto and they could not discredit masood mahmood...masood mahmood probably had no grudge against a victim who was not too prominent as a politician.and one should probably study the perpretrators who were military employees of a tank rebuild factory...so any reason for the death sentence arises from the judges belief that bhutto probably ordered the murder or even political sentiments against a upstart at times a brilliant politician who was aligned against the other parties which now exist as the PMLn, JI, JUIf, mqm etc...at that time the politics was something like the demagoguery of imran and similarly a country against one person at least in politics...That the death sentence served the interests of the bhutto clan goes without saying...Benazir had assured Bhutto of a respectful burial in a shade..so what the CJ has todo is to decide if there was sufficient evidence for the court decisions...is there any new evidence... and whether the decision should be set aside in its entirety or reopen the case ab initio...the CJ's bias is quite clear and many will wait to see what he does...even if he decided that the courts verdict was based on no real evidence...despite the FSF having no other reason for its existence...so the biased CJ can just decide that the decision might have been over and above and that the death sentence might be downgraded to a sentence of life which would be normal...there is also no real evidence even of threats of any real ordering of the decision by the military junta even though one high court judge ran away into exile ...even though zia ul haq supposedly kicked bhutto with his boots in jail after the judgement...the bias was not judicial but caused by the temperament of the coup plotter and probably the nature of the judiciary at the time...who had reasons to eliminate bhutto as it would end the only threat to the martial law regime...!a real investigation into various aspects might reveal more evidence that is at present not available.

Feb23-2024-- apparently a Punjab assembly session has taken place where oaths were taken...there are 199 PMLn supporting legislators including 42 on reserved seats...while there are said tobe 116 pti backed independents who supposedly have joined the SIC..98 SIC members took oath too along with members of PPP 11 and PMLq-8. IPP 5 and others...20 of 23 non pti backed independents joined the PMLn...whether the SIC can get reserved seats is not clear...the date for filing reserved seats nominees has passed and the SIC did not file a list...that leaves another matter for the court or the ECP to decide...in punjab the SIC could be allotted around 25 reserved seats...technically it does not matter given the nature of seat distribution...there are 270 reserved seats countrywide...at least 50 pti backed independents are said to have joined the SIC whether in the punjab or center is unclear...the candidates have to join a party within three days of notification...The SIC was initially a Barelvi grouping opposing Deobandis...at the moment it is a seemingly a shiite led group close to another shiite group the MWM...they are led by iraqi/iranian seminary educated clerics...what happened to the barelvi organisations that initially were part of the SIC is not clear...The PTI is said to hold another internal election on the March 3...if it is approved than the PTI will get its symbol back...how the SIC will integrate with the new PTI or whether it can is yet tobe seen...

Feb20-2024--50 PTI independents have become members of the SIC a dubious supposedly shiite-sunni combine...that means that the PTI independents no longer exist...however the pTi has again initiated a court case in KP to regain its reserved seats and challenge the ECP/SC judgement onits symbol...since the PTI has joined the SIC the reserved seats will go to the SIC...what the PTI expects to play both sides is unclear...the maulana fazlur rehman statement on who was behind the no trust move has already been debunked...and the PTI itself delayed the no trust from Mar9 to April 6 alongwith the illegal hoopla of the cipher...removing a primeminister thru a no trust is a legal move as the PTI had been rendered a minority after its coalition partners stepped away from it...imran had been accusing his coalition partners of blackmail...
Feb20-2024--The SC has adjudicated that it cannot adjudicate on vice , morality, honesty or the qualities required in articles 62-1(d,e,f) and probably article 63 as well...what this means is that candidates can be good or bad but it cannot stop them from competing in elections...that states that the constitution is erroneous to the extent of articles 62 and 63 and they must be unconstitutional at best...it has not been difficult for the courts to adjudge on clear lines of criminality but they cannot say if a person is honest/good/bad even in specific cases that are brought before it...

Feb20-2024--the big news is that the PMLn might look further afield for economic advisors rather than Miftah and Ishaq Dar the two biggest PMLn failures...the people they are looking at work at the same bank... Habib Bank...one is the Shiite Ismaili supremo of the AKD organization and chairman of Habib Bank, and the other is the president of Habib bank...from photographs they look like stiff necks unable to accept change...but having good education and experience credentials...Allana has degrees from the ordinary Mcgill and Wisconsin suggesting that he might have been poorer initially...while Aurangzeb has degrees from Wharton school of business(Pennsylvania)...they might have a better reception with the IMF and world bank...and could explain to the army why they should not takeover agricultural land and attempt foolishly to run the economy too...further overseas investment into a battered structurally entity would not produce any gain for the people and bleed foreign exchange in profits repatriation...
Feb20-2024--The elections are a mechanism of change...the political parties are the means as they make that change occur...according to our laws election results can only be challenged in the election tribunals...this the fourth election in which change has meaningfully occurred in two provinces while sindhis and pukhtuns have refused to accept the need to change...however the extent of the change and the results are similar to 2018...in baluchistan the BAP has been almost wiped out by three bigger parties...the status quo has been maintained in the other three provinces...the ideas that the PTi was pukhtun in nature and anti development/anti punjab reduced the votes of the pTI in Punjab...it also suffered when compared to the PMLn era of development...simple things like cleaning up Rawalpindi thru a efficient turkish company and building a metro ...the voters noticed that the PTI did no development in the rawalpindi area at all...they noticed that the PTI was generally corrupt in its rule of the punjab and that it forced the NAB not to indict PTI corruption in KP...!That the political parties succeeded in denting the PTi in punjab, sindh and baluchistan was unnerving to the pTI which swept the KP...!The PTI was a minority party in 2018 too and it was the nature of its 2018 coalition rule that it would have great difficulty in forming even a passable government majority in 2024...but it refused to even talk to the PPP or MQMp who might have given it a lifesaving governing coalition...and joining a 30:30:30:10 national coalition was thus totally out of the question...however the change was only marginal but effective nevertheless...and change is what a election is all about...that is not rigging...That the beaurocracy, caretakers, establishment(aka army), ECP and Judiciary were on the same page goes without saying...The May9 antics of the PTi in which military installations were attacked did not help its cause either...

Feb18-2024--in a major blow to the elections credibility a rawalpindi district commissioner who was retiring on Mar13... today took responsibility of rigging the elections and even blamed the CJ...!others said he was a phsychopath and how could a commissioner be under the pressure of foreigners and social media...the ECP said that the district commissioner had no role in the elections...he even said that votes were being stamped even after 10 days which is technically not possible...The PMLn which caused a major upset in the division says that there were no unusual results, and most voting was quite close...the losing parties like the PTI protesting even losing eight seats in KP are quite shameful and horrid in trying to attack the elections credibility in which they won over 90 PK seats in KP plus around 40 NA seats...nobody is challenging punjab results barring the PTi while JI/PTI is challenging elections in karachi while baluch parties are challenging the victories by major parties in balochistan..GDA is also challenging sindh results...PTI could not mount a sizable protest in peshawar against the elections...
Feb17-2024--In further evidence in the SJC vs mazher naqvi another witness submitted evidence of buying a plot from mazhar ali naqvi...he again mentioned the Rs50 million cheque from smart city...apparently the developer who bought the plot says the money was owed to him by smart city for 600 kanals of land in fatej Jhang...The gulberg property previously owned by varda naqvi wife of the caretaker chiefminister...earlier the plot said tobe in cantonment near askari2..the property sold to judge naqvi who than sold it to Mr Khan...there are ten complaints against the judge for various land acquisitions...later the SJC heard of three plots bought from FGEHF...the ETPB told the SJC that the tenancy of an office space was transferred to the judges son at a lower than normal price at diyal singh mansion...The SJC said that it could hear complaints against other judges too...mazhar nqvi said that the SJC could not hear complaints against former judges according to article 209...apparently a court is already seized with issue.
Feb17-2024--at last imrans brain corrects itself and he decides to sit in the opposition...in the center and punjab...a big demo on the hyderabad motorway by the GDA against rigging in sindh...the Pti demo on the peshawar motorway was peanuts in comparision...GDA suggests that with the problems that the PPP and PMLn are having in various assemblies deciding things the next government may last from one to two years so everybody had better be prepared for a new election...smooth sailing probably only for the Pti in KP...Khurshid shah says that they will take the parliamentary committee chairmans...The PPP seems to think that they can benefit politically by their strange attitudes given that the PMLn has been dealt a blow at the top but ministries are important and probably the speakership at the center which the PPP wants and so does the PMLn...how the new government works out with the SFIC is yet tobe seen...military apparently trying to remain hidden but seemingly wants huge chunks of land...the only suggestion at the moment seems to be dividing government ...three years for PMLn and two for the PPP...ie if they last five years...PPP however reluctant to follow orders...!ones vegetable seller has some ideas...selling carrots for Rs.2 a kilo and peas for Rs.160 a kilo...to reduce inflation in the real sense u need to reduce tariffs and prices
Feb16-2024--In a continuation the SJC heard the details of the corruption reference against former judge mazhar ali naqvi...apparently the judge bought a property in the lahore cantonement area Sant jones park for Rs130 million in 2022...the amount was paid in two 50 million cheques and 30 million in cash...one of the 50 million cheques came from a company called Lahore smart city (pvt) limited...the properties worth in 2022 said tobe 270 million and 377 million now...and the deed was recorded at 106 million...a lot of wheeling and dealing for a judge of the superior courts...a superior court judges salary is around a million nowadays...if the judge just survived on daal roti than he could possibly save a 100 million...if the lahore smart city turns out tobe the property of the judges son in law than that could save him...!what can rhey do if they say it is corruption..!technically they cant do anything apart from referring the case to NAB or ACE..it might look good if they confiscated the property as a corruption proceeds...
